July 20, 1999 » Supreme Court Decisions: Impact on the ADA's Future

The U.S. Supreme Court heard a record number of ADA-related cases this term. In L.C. vs. Olmstead, the Court makes decision on the "most integrated setting" application to state programs and services. The question to the Court: does the ADA require Title II entities to place people with disabilities in inclusive community-based programs instead of segregated institutional environments where appropriate? Join the Great Lakes DBTAC for a discussion of ADA-related Supreme Court decisions with John Wodatch, Chief of the Disability Rights Section of the U.S. Department of Justice. During this session, we will review the Olmstead decision, other Supreme Court decisions this term, and the impact they may have on future compliance and litigation of the Americans with Disabilities Act.

May 22, 2001 » Supreme Court Docket: Demystifying the Garrett Decision

The U.S. Supreme Court ruled that state employees are barred from filing suits seeking money damages because states are immune from such suits under the 11th Amendment of the Constitution. This session will explore the ramifications of the decision for employees of state governments and discuss other avenues for pursuing a resolution of charges of employment discrimination.
 
 

November 28, 2000 » Question to the Supreme Court: Is Title II Unconstitutional?

The question as to whether or not Congress exceeded its authority by giving state employees the right to sue their employer in federal court under the ADA continues to be debated. This special session of the ADA Distance Learning series will explore the constitutionality issues and questions before the Supreme Court. There will also be discussion of the previous decisions split amongst the federal circuit courts, the political pressure and the future ramifications for enforcement of Title II.
 
 

November 20, 2001 » Supreme Court & Disability Law: A Look at the 2001-2002 Term

Discussion will include some of the trends in case law at the lower courts which may have an impact on decisions at all levels, including issues that may find their way to the Supreme Court. In addition, presenter will review how the courts are interpreting the ADA Amendments Act of 2008.
